What Is California’s Lemon Law?
California’s lemon law is formally known as the Song-Beverly Consumer Warranty Act, a consumer protection statute that holds manufacturers accountable for defective vehicles. The Song-Beverly Act applies when a vehicle has a defect that substantially affects its use, value, or safety and can’t be repaired after a reasonable number of attempts.
Which Vehicles Are Covered
The Song-Beverly Act covers a broad range of personal-use vehicles, whether purchased or leased:
- Cars, trucks, SUVs, and vans
- New vehicles and certified pre-owned (CPO) vehicles sold by an authorized dealership with a manufacturer-issued warranty at the time of sale
Repair-Attempt Thresholds & Deadlines
Under Civil Code §1793.22, the law establishes general repair-attempt thresholds that may indicate a vehicle qualifies: two or more attempts for serious safety defects (such as brake, steering, or stalling issues); four or more attempts for non-safety defects; or 30 or more cumulative days out of service. These thresholds generally apply within the first 18 months or 18,000 miles of ownership, whichever comes first. Whether a specific vehicle qualifies depends on the facts of each case, which is why speaking with a lemon law attorney early is important.
California lemon law claims must generally be filed within one year after the manufacturer’s express warranty expires and no later than six years from the vehicle’s original delivery date. What the Manufacturer May Owe You

- Pay civil penalties of up to two times your actual damages if the manufacturer willfully violated the Act
